Terms and Conditions

1. General Terms and Conditions

These Terms and Conditions of Sale are applicable to all offers featured on the Reviving Type website ( and to all contracts concluded via the website between Acute Publishing and the Customer regarding the delivery of books and related articles (hereafter: the Contract). Any terms and conditions, general or otherwise, maintained by the Customer – including purchase conditions – are hereby explicitly declined by Acute Publishing and are not considered part of the Contract.

2. Definitions

In these Terms and Conditions of Sale, the following definitions apply: Studio Nóra Békés | Acute Publishing: the publisher and distributor of the title “Reviving Type” (ISBN: 9 789 090 321 899), located at Lieve Verschuierstraat 61a, 3021ZD Rotterdam, registered with the Rotterdam Chamber of Commerce (KvK), KvK number 72204613. Website: the Internet site where orders can be placed with Acute Publishing by means of electronic communications. Customer: the natural person or legal entity that has concluded a contract with Acute Publishing, via the latter’s Website, for the purchase of one or more products. The BTW (Netherlands VAT) Number of Acute Publishing is NL002526478B26.

3. Prices

1. The sale of products shall be subject to the prices and rates listed on the Website at the time of the conclusion of the Contract. Acute Publishing is not bound by prices agreed upon or made known by Acute Publishing or its suppliers in any way other than on the Website for products ordered via the Website, unless otherwise explicitly agreed upon in writing between Acute Publishing and the Customer.

2. All prices and rates charged by Acute Publishing include VAT, unless otherwise explicitly indicated. Listed prices do not include shipping and handling costs, unless otherwise explicitly indicated.

3. Shipping and handling costs vary according to the volume and destination of the shipment. Shipping and handling rates are listed under Delivery.

4. Acute Publishing retains the right to modify its prices for any reason. Modified prices and rates apply from the moment they are listed on the website. Publication of erroneous prices is excepted.

4. Offer, Order and Contracts

1. All offers by Acute Publishing are non-binding. An offer on the website can be withdrawn by Acute Publishing within two working days following the receipt of an order from the Customer, in which case no Contract is concluded.

2. The Contract is concluded when the Customer places an order via the Website and Acute Publishing confirms in writing (via e-mail) that this order has been accepted.

3. The systems and records of Acute Publishing are considered to provide an accurate representation of communications exchanged as well as orders, deliveries and payments effected, unless the Customer can present proof of the contrary.

4. The Customer may return a product (undamaged) to Acute Publishing within 14 working days of receipt for a full refund. The Customer is liable for all shipping and handling costs for the return of the product. Acute Publishing shall reimburse the Customer for the full amount within one month. This rule does not apply to highly specific items ordered on behalf of the Customer, or if another delivery date has been agreed upon.

5. Should Acute Publishing prove unable to deliver the items contracted within one month following the contracted delivery date, the Customer is entitled to cancel this order without further conditions.

5. Delivery

1. Products ordered shall be delivered to the Customer, to wit: delivery of the items to the address provided by the Customer, or, if the items cannot be delivered to this address or be deposited in a post box, delivery to an alternative address indicated in writing, specifying how the addressee can take possession of the items. Upon delivery, the Customer is liable for the items.

2. Should the Customer express the wish to pick up the products ordered via Acute Publishing the Customer may pick up the products ordered within three weeks after the order was accepted. Date and location will be discussed between Acute Publishing and the Customer.

3. In case ‘Track and Trace’ shipping was requested, the Customer receives a notification about the shipping date of the post and a ‘Track and Trace’ number that allows them to follow the shipment. In any other case, the period indicated on the website regarding the processing of the order and shipping time is purely informative, and does not constitute a contractual deadline.

4. Acute Publishing makes use of the services of the Dutch National Post (PostNL), and does not take responsibility for any disruptions in the services of this company, such as delays, loss of shipment without ‘Track and Trace’ number or damaged package.
5. Acute Publishing is legally entitled to suspend its fulfillment of any obligations to the Customer as long as the Customer has not fulfilled his/her obligations (including payment) to Acute Publishing, for whatever reason.

6. Shipping rates vary according to the size and weight of the products ordered, according to the pricing rates specified by the Dutch National Post (PostNL, The following list gives an overview of the approximate expectable shipping prices. The actual shipping price might differ, in case of, for instance, special shipping requests or if the PostNL alters its pricing rates.

6. Payment

1. In principle, invoicing by Acute Publishing takes places after the order has been placed on the website or via email, before the products are shipped. 

2. Payment must be made by the Customer to a bank account specified by Acute Publishing within 2 weeks after the invoice was issued through bank transfer, iDeal or PayPal, unless agreed differently in writing (e-mail).

3. Except by written permission from Acute Publishing, the Customer is not entitled to offset any payment obligation to Acute Publishing through a claim against Acute Publishing, for whatever reason.

4.Acute Publishing retains the right to request, at any time, a pre-payment, automatic bank account debit, cash payment, or payment collateral from the Customer.

5. If payment is not effected with the specified deadline, the Customer is in default without notice and Acute Publishing is legally entitled to charge the Customer legal interest from the due date. In this case, Acute Publishing is further legally entitled to make a claim against the Customer for all actually incurred legal costs (including attorney fees) and extrajudicial collection costs, calculated according to the collection rate set by the Netherlands Bar.

7. Returns and Complaints; Return Shipments

1. The Customer must notify Acute Publishing of any complaint concerning the products delivered, in writing and with a clear description of the complaint, within one week following delivery. Failure to provide such notification absolves Acute Publishing of any liability for any defects in products and/or services delivered.

2. Should the Customer receive either a damaged product, or one other than the one ordered, the Customer is legally entitled to return this product to Acute Publishing. The Customer is required to return the unwanted products in suitable packaging and to indicate the reason for a return in writing. Upon receipt of the returned products, Acute Publishing, if it deems this to have been returned for a valid reason, shall deliver an undamaged product or the product that was ordered.

3. Should the Customer, for any reason, not wish to accept the product, he or she retains the right to return said product to Acute Publishing, by post or in person, within 2 weeks following delivery. Return shipments shall be accepted only if the returned product is undamaged. The Customer is entirely liable for all costs of return shipments.

8. Liability and Indemnity

1. The presence of a defect does not entitle the Customer to any suspension or reduction of his payment obligations in regard to the product.

2. The total liability of Acute Publishing for demonstrable failure in the fulfillment of the delivery of any service is limited to compensation for direct losses, up to an amount equal to the price stipulated for this service (excluding VAT).

3. The liability of Acute Publishing for indirect losses, including consequential loss, lost profit, missed savings, loss from the suspension of business operations and any losses other than those specified in Article 8.2 is excluded.

9. Termination of the Contract

Acute Publishing retains the right to terminate the Contract with the Customer, with immediate effect and without prior notice, by means of a written notification, if:

• the Customer, in spite of appropriate notice, demonstrably fails to meet the obligations incumbent upon him or her;

• the Customer is granted (provisionally or otherwise) a moratorium on payments, or the Customer is declared bankrupt;

• the Customer ceases, in whole or in part, and/or otherwise liquidates his or her business operations, or, without prior written permission from Acute Publishing, significantly modifies his or her business activities or transfers these to a third party.

10. Retention of Title

Acute Publishing retains title to all (moveable) items delivered to the Customer until such time as the Customer has fulfilled all obligations to Acute Publishing under any agreement for the delivery of books or other products, including obligations related to the failure to fulfill such agreements.

11. Intellectual and Industrial Copyrights

The Customer is prohibited (and this applies, if necessary, as a supplement to Acute Publishing copyrights or related rights) from reproducing, in whole or in part, any book or electronic product delivered and/or made available to the Customer by Acute Publishing, or making such products or their reproductions public, without prior written permission from Acute Publishing if this is done (I) for the benefit of a business, organization or institution, (II) for individual practice, study or use that is not of a strictly private nature or (III) for inclusion in a daily or weekly newspaper or periodical (including in digital form) or in a broadcast of a radio or television program, unless explicitly stipulated otherwise in these Terms and Conditions of Sale.

12. Force Majeure

For Acute Publishing force majeure includes any failure in the execution of the Contract that is not the fault of Acute Publishing or attributable to Acute Publishing by law, applicable jurisprudence or generally accepted standards, or is the result of the fact that a product ordered by the Customer is temporarily unavailable from Acute Publishing or its supplier.

13. Applicable Law and Disputes

All contracts concluded by Acute Publishing with the Customer are subject to Dutch law exclusively. All disputes related to the Contracts concluded by Acute Publishing with the Customer shall be brought before a court in the Netherlands with proper jurisdiction.

Acute Publishing considers respect for the personal privacy of its customers and visitors to its websites to be of paramount importance. The personal data of business partners, customers and visitors are treated and secured with the greatest possible care. Acute Publishing adheres to the requirements stipulated by the Personal Data Protection Act (Wet Bescherming Persoonsgegevens), the Telecommunications Act (Telecommunicatiewet) and other privacy legislation and regulations in the Netherlands.

15.1 Use of Postal Address

TAcute Publishing will ask you to provide your postal address when you order a product with a shipment. Acute Publishing uses postal addresses submitted to us exclusively in order to fulfill shipment requests and complete invoices.

15.2 Use of E-mail Address

If you have provided us with your e-mail address when purchasing a product or service from Acute Publishing, this e-mail address may be used by Acute Publishing for commercial, public service or charitable communications related to similar Acute Publishing products or services, unless you have indicated that you do not wish to receive such communications by e-mail. If you have provided us with your e-mail address for a reason other than the purchase of a product or service from Acute Publishing, this e-mail address will exclusively be used for commercial, charitable or public service e-mails if you have given Acute Publishing express permission to that effect. Every e-mail will include a way to object to any further use of your e-mail address by Acute Publishing for commercial, public service or charitable ends.

15.3 Use of Telephone Number

Acute Publishing may ask you to provide a telephone number in case you order a product via the website. Acute Publishing will use this telephone number exclusively to grant the flawless fulfillment of your order and completion of your shipment. No phone numbers will be used for purposes of telemarketing, or given to a third party. In principle, telephone numbers will be deleted from our administration system once the customer’s order is completed. Acute Publishing might retain telephone numbers of regular customers and partners on the occasion of a long term collaboration.

15.4 Opting Out

In providing service and information, Acute Publishing takes your preferences into account as much as possible. If you no longer wish to receive information about (new) products and services (by post, e-mail, etc.) you can always (in addition to the opt-out options listed in this statement) notify us of this by e-mail at or in writing at Acute Publishing, Lieve Verschuierstraat 61a, 3021ZD Rotterdam. Your opt-out of the use of your postal address, e-mail address or telephone number will be processed by Acute Publishing within one month. For this reason, a few communications may reach you after you have opted out. We apologize for any inconvenience.

15.5 Review and Correction of Your Data

You may request and review the personal information Acute Publishing has about you at any time; at your request, this information will be modified according to your indications. 15.6 Acute Publishing and Other Websites

If you access a third-party website via a link on the Acute Publishing website, Acute Publishing is not responsible for the way in which the administrator of the third-party handles your personal data. For this reason, we advise you to always read the privacy statements of the websites you visit.

15.7 Changes

Acute Publishing retains the right to make changes to this Privacy Statement, for example in response to changes in legislation. For this reason, we advise you to check this Privacy Statement regularly.
